Affiliate Program Terms

Introduction

These Affiliate Program Terms (hereinafter "Terms") govern your participation in the Magic Position affiliate program (hereinafter "the Program").

The Affiliate Program is tier 1 of the Magic Position affiliate system. Affiliates recommend Magic Position directly to customers and earn a commission on their payments. A partner program (tier 2), designed for recruiting affiliates, is available separately — see the Partner Program Terms.

By enrolling in the Program, you agree to be bound by these Terms. If you do not accept these terms, please do not participate in the Program.

1. Definitions

• "Affiliate": any individual or entity enrolled in the Program
• "Referred Customer": any new Magic Position customer who subscribes through your affiliate link
• "Commission": the compensation paid to the Affiliate for each Referred Customer
• "Affiliate Link": the unique URL assigned to the Affiliate for tracking referrals
• "Cookie": the tracking mechanism used to attribute conversions

2. Program Enrollment

2.1 Eligibility

To participate in the Program, you must:

• Be at least 18 years old
• Have a bank account or Stripe Connect account
• Provide accurate and complete information during registration
• Comply with these Terms

2.2 Approval

Program enrollment is subject to our approval. We reserve the right to reject or terminate any enrollment without providing justification.

2.3 One account per person

Each Affiliate may only hold one affiliate account. Creating multiple accounts will result in immediate termination and forfeiture of all commissions.

3. Commissions

3.1 Commission rate

Affiliates earn a commission of 25% on each payment made by their Referred Customers.

3.2 Commission duration

Commissions are paid for a maximum period of 12 months per Referred Customer, starting from the date of their first subscription.

3.3 Commission calculation

Commissions are calculated on the net amount paid by the Referred Customer, after deduction of taxes, transaction fees, and any refunds.

Calculation basis: Magic Position subscription list price ($39/month or €39/month).

3.4 Holding period

Commissions remain pending for a period of 14 days after each payment, corresponding to the legal withdrawal period. If the Referred Customer requests a refund during this period, no commission will be owed.

4. Tracking and Attribution

4.1 Affiliate link

Each Affiliate receives a unique affiliate link in the format:
https://magicposition.com/?ref=YOUR_CODE

4.2 Tracking cookie

When a visitor clicks on your affiliate link, a tracking cookie is set for a duration of 30 days. If the visitor subscribes during this period, you will be credited with the commission.

4.3 Attribution

In case of attribution conflict (multiple affiliates), the first click will take priority (first-click attribution).

4.4 Exclusions

The following do not qualify for commission:

• Purchases made by the Affiliate themselves
• Existing customers who re-subscribe
• Subscriptions obtained through fraudulent means
• Cancelled or refunded orders

5. Commission Payments

5.1 Minimum threshold

Commissions are payable from a minimum threshold of €50.

5.2 Payment method

Payments are made via Stripe Connect directly to your bank account.

5.3 Frequency

Eligible commissions are paid automatically once the minimum threshold is reached and the holding period has elapsed.

5.4 Tax obligations

The Affiliate is solely responsible for their tax obligations. Commissions paid constitute taxable income. Magic Position may be required to report commissions paid to tax authorities in accordance with applicable regulations.

6. Affiliate Obligations

6.1 Ethical promotion

The Affiliate agrees to promote Magic Position honestly and transparently, without:

• Making false statements about the service's features or performance
• Promising guaranteed earnings or financial results
• Using spam or harassment practices
• Creating confusion about their affiliation with Magic Position

6.2 Disclosure

The Affiliate must clearly disclose their affiliate relationship when promoting Magic Position, in accordance with applicable regulations (including FTC rules and European equivalents).

6.3 Intellectual property

The Affiliate may use logos, images, and marketing resources provided by Magic Position only for authorized promotion purposes. Any modification requires prior written authorization.

6.4 Prohibited activities

The following are strictly prohibited:

• Purchasing advertising on "Magic Position" brand keywords or similar terms
• Using spam, unsolicited emails, or any illicit promotional means
• Creating websites imitating Magic Position's appearance
• Using "cookie stuffing" techniques or fraudulent clicks
• Promoting Magic Position on illegal, adult, or unethical content sites

7. Dashboard

7.1 Access

The Affiliate has access to a dashboard enabling real-time tracking of:

• Number of clicks on their affiliate link
• Number of conversions (Referred Customers)
• Commission amounts generated
• Payment history

7.2 Data accuracy

While we strive to provide accurate data, displayed statistics may have a slight delay. Final amounts are those validated at payment time.

8. Program Modifications

8.1 Changes

Magic Position reserves the right to modify these Terms, commission rates, or any other Program characteristics, with 30 days notice sent by email.

8.2 Continuation

Your continued participation in the Program after notification of changes constitutes acceptance of the new Terms.

9. Termination

9.1 By the Affiliate

You may withdraw from the Program at any time by contacting us. Pending commissions (having exceeded the holding period and reached the minimum threshold) will be paid to you.

9.2 By Magic Position

We may suspend or terminate your participation in the Program at any time, particularly in case of:

• Violation of these Terms
• Extended inactivity (no conversions for 12 months)
• Fraud or attempted fraud
• Damage to Magic Position's reputation

9.3 Consequences of termination

Upon termination:

• Your affiliate link will be deactivated
• Pending commissions not reaching the minimum threshold will be forfeited
• Commissions related to fraudulent conversions will be cancelled

10. Relationship with the Partner Program

10.1 Program combination

An Affiliate may simultaneously be a partner (tier 2) of the Magic Position affiliate system. In this case:

• They earn 25% commission on customers they bring directly through their affiliate link (tier 1)
• They earn 5% commission on customers brought by affiliates they recruit as a partner (tier 2)
• Both types of commissions are independent and cumulative

10.2 Commission independence

Affiliate commissions (25%) and partner commissions (5%) are calculated and paid independently. A partner earning 5% does not reduce the 25% commission paid to the affiliate in any way.

11. Limitation of Liability

11.1 No warranty

The Program is provided "as is". Magic Position does not guarantee any minimum level of income or conversions.

11.2 Limitation

To the extent permitted by law, Magic Position's total liability to the Affiliate is limited to the total amount of commissions paid during the past 12 months.

12. Confidentiality

The Affiliate agrees to maintain the confidentiality of their login credentials and any non-public information relating to the Program.

13. Governing Law

These Terms are governed by French law. Any dispute shall be submitted to the competent courts.
