Partner Program Terms
Terms and conditions governing participation in the Magic Position partner program (tier 2 of the affiliate system).
Introduction
These Partner Program Terms (hereinafter "Terms") govern your participation in the Magic Position partner program (hereinafter "the Partner Program").
The Partner Program is tier 2 of the Magic Position affiliate system. Unlike the affiliate program (tier 1) where affiliates recommend Magic Position directly to customers, partners recruit and support affiliates, and earn a commission on sales made by those affiliates.
By submitting your application to the Partner Program, you agree to be bound by these Terms. If you do not accept these terms, please do not participate in the Partner Program.
1. Definitions
- "Partner": any individual or entity admitted to the Partner Program after validation of their application
- "Recruited Affiliate": any affiliate enrolled in the Magic Position affiliate program (tier 1) through the Partner's recruitment link
- "End Customer": any Magic Position customer who subscribes through a Recruited Affiliate's affiliate link
- "Partner Commission": the compensation paid to the Partner, calculated on End Customer payments generated by their Recruited Affiliates
- "Recruitment Link": the unique URL assigned to the Partner for tracking affiliate recruitment
2. Partner Program Enrollment
2.1 Eligibility
To participate in the Partner Program, you must:
- Be at least 18 years old
- Have a bank account or Stripe Connect account
- Provide accurate and complete information during application
- Demonstrate a professional network in trading, investment, or financial education
- Comply with these Terms
2.2 Selective program
The Partner Program is a selective program requiring an application. Unlike the affiliate program (tier 1) which is open to all, admission to the Partner Program requires validation by our team.
Our team reviews each application within 48 business hours. We reserve the right to reject any application without providing justification.
2.3 Selection criteria
Criteria evaluated when reviewing your application include:
- The relevance of your professional network (trading, investment, financial education)
- Your ability to identify and recruit content creators, educators, or influencers
- Your commitment to promoting Magic Position ethically and professionally
2.4 One account per person
Each Partner may only hold one partner account. Creating multiple accounts will result in immediate termination and forfeiture of all commissions.
3. Commissions
3.1 Commission rate
Partners earn a commission of 5% on each payment made by End Customers of their Recruited Affiliates.
Important clarification: The partner commission is calculated on the amount paid by the End Customer, not on the commission paid to the Recruited Affiliate. The Recruited Affiliate receives their own 25% commission independently.
3.2 Commission duration per customer
Partner commissions are paid for a maximum period of 12 months per End Customer, starting from the date of that End Customer's first subscription.
3.3 Duration of relationship with Recruited Affiliates
The relationship between the Partner and their Recruited Affiliates is unlimited in time. As long as a Recruited Affiliate is active in the affiliate program, the Partner earns commissions on all new End Customers brought by that affiliate.
Example: If a Partner recruits an affiliate in January 2026, and that affiliate continues to bring new customers in 2027, 2028 and beyond, the Partner will earn 5% on each of those customers for their first 12 months of subscription. The revenue stream is potentially unlimited.
3.4 Commission calculation
Commissions are calculated on the net amount paid by the End Customer, after deduction of taxes, transaction fees, and any refunds.
Calculation basis: Magic Position subscription list price ($39/month or €39/month).

3.5 Leverage effect
The key advantage of the Partner Program lies in the leverage effect: the more high-performing affiliates you recruit, the more your passive income grows. The number of affiliates you can recruit is unlimited.

3.6 Holding period
Commissions remain pending for a period of 14 days after each End Customer payment, corresponding to the legal withdrawal period. If the End Customer requests a refund during this period, no commission will be owed.
3.7 Combination with the affiliate program
A Partner may simultaneously be an affiliate (tier 1). In this case:
- They earn 25% commission on customers they bring directly through their affiliate link
- They earn 5% commission on customers brought by their Recruited Affiliates
- Both types of commissions are independent and cumulative
4. Tracking and Attribution
4.1 Recruitment link
Each Partner receives a unique recruitment link in the format:https://magicposition.com/?partner=YOUR_CODE
4.2 Affiliate attribution
When an affiliate enrolls in the affiliate program through your recruitment link, they are automatically and permanently linked to your partner account. This attribution is permanent.
4.3 Attribution chain
The attribution system works on two tiers:
- Tier 1 (Affiliate → Customer): The Recruited Affiliate shares their own link (
?ref=CODE). The customer who subscribes through this link is attributed to the affiliate. - Tier 2 (Partner → Affiliate → Customer): The Partner automatically earns 5% on each End Customer attributed to their Recruited Affiliates.
4.4 Exclusions
The following do not qualify for partner commission:
- Purchases made by the Partner themselves
- Purchases made by the Recruited Affiliates themselves
- Conversions obtained through fraudulent means
- Cancelled or refunded orders
- Customers already attributed to another affiliate before recruitment
5. Commission Payments
5.1 Minimum threshold
Partner commissions are payable from a minimum threshold of €50 (or equivalent).
5.2 Payment method
Payments are made via Stripe Connect directly to your bank account. Commissions in EUR and USD are managed separately.
5.3 Frequency
Eligible commissions are paid automatically once the minimum threshold is reached and the holding period has elapsed.
5.4 Tax obligations
The Partner is solely responsible for their tax obligations. Commissions paid constitute taxable income. Magic Position may be required to report commissions paid to tax authorities in accordance with applicable regulations.
6. Partner Obligations
6.1 Ethical recruitment
The Partner agrees to recruit affiliates honestly and transparently, without:
- Making false promises about potential earnings from the affiliate program
- Using spam or harassment practices for recruitment
- Recruiting affiliates through deceptive or fraudulent means
- Enticing existing affiliates of other partners to switch partners
6.2 Affiliate support
The Partner is encouraged to support their Recruited Affiliates to help them succeed. This support may include:
- Sharing best practices for promotion
- Advice on effective distribution channels
- Help optimizing conversions
6.3 Disclosure
The Partner must clearly disclose their partner relationship when recruiting affiliates, in accordance with applicable regulations.
6.4 Intellectual property
The Partner may use logos, images, and marketing resources provided by Magic Position only for authorized promotion and recruitment purposes. Any modification requires prior written authorization.
6.5 Prohibited activities
The following are strictly prohibited:
- Guaranteeing income to potential affiliates
- Using spam, unsolicited emails, or any illicit recruitment means
- Creating websites imitating Magic Position's appearance
- Using fraudulent techniques to artificially inflate affiliate numbers
- Recruiting affiliates on illegal, adult, or unethical content sites
- Purchasing advertising on "Magic Position" brand keywords or similar terms
7. Dashboard
7.1 Access
The Partner has access to a dashboard enabling real-time tracking of:
- Number of Recruited Affiliates and their status
- Number of conversions (End Customers) generated by their affiliates
- Partner commission amounts generated, by currency (EUR/USD)
- Payment history
- Individual performance of each Recruited Affiliate
7.2 Data accuracy
While we strive to provide accurate data, displayed statistics may have a slight delay. Final amounts are those validated at payment time.
8. Program Modifications
8.1 Changes
Magic Position reserves the right to modify these Terms, commission rates, or any other Partner Program characteristics, with 30 days notice sent by email.
8.2 Continuation
Your continued participation in the Partner Program after notification of changes constitutes acceptance of the new Terms.
9. Termination
9.1 By the Partner
You may withdraw from the Partner Program at any time by contacting us. Pending commissions (having exceeded the holding period and reached the minimum threshold) will be paid to you.
9.2 By Magic Position
We may suspend or terminate your participation in the Partner Program at any time, particularly in case of:
- Violation of these Terms
- Extended inactivity (no affiliates recruited for 12 months)
- Fraud or attempted fraud
- Damage to Magic Position's reputation
- Recruiting affiliates through unethical means
9.3 Consequences of termination
Upon termination:
- Your recruitment link will be deactivated
- Pending commissions not reaching the minimum threshold will be forfeited
- Commissions related to fraudulent conversions will be cancelled
- Recruited Affiliates remain in the affiliate program but are no longer linked to your partner account
10. Relationship Between Affiliate Program and Partner Program
10.1 Two complementary programs
The Partner Program (tier 2) and the affiliate program (tier 1) are two distinct but complementary programs within the Magic Position affiliate system.
10.2 Commission independence
Partner commissions (5%) and affiliate commissions (25%) are calculated and paid independently. The partner commission does not reduce the commission paid to the Recruited Affiliate in any way.

11. Limitation of Liability
11.1 No warranty
The Partner Program is provided "as is". Magic Position does not guarantee any minimum level of income, conversions, or number of recruited affiliates.
11.2 Limitation
To the extent permitted by law, Magic Position's total liability to the Partner is limited to the total amount of commissions paid during the past 12 months.
11.3 Affiliate performance
Magic Position does not guarantee the performance of Recruited Affiliates. The Partner acknowledges that their revenue depends on the activity and results of their Recruited Affiliates.
12. Confidentiality
The Partner agrees to maintain the confidentiality of their login credentials, information relating to their Recruited Affiliates, and any non-public information relating to the Partner Program.
13. Governing Law
These Terms are governed by French law. Any dispute shall be submitted to the competent courts.
