Introduction

These Terms of Service (hereinafter "Terms") govern access to and use of the Magic Position application and associated services (hereinafter "the Service").

By using our Service, you agree to be bound by these Terms. If you do not accept these terms, please do not use our Service.

"Account": the User's personal space on the Service

2. Description of the Service

Magic Position is a risk management and trading automation application that allows users to:

Automatically calculate their position sizes
Manage their risk exposure
Connect their trading accounts via API
Analyze their trading performance

3. Registration and Account

3.1 Account Creation

To use the Service, you must create an account by providing accurate and complete information. You are responsible for the confidentiality of your login credentials.

3.2 Age Requirements

You must be at least 18 years old to use the Service.

3.3 Account Responsibility

You are solely responsible for all activities conducted under your account. In case of unauthorized use, you must inform us immediately.

4. Subscription and Payment

4.1 Subscription Plans

The Service is offered as a monthly or annual subscription. Prices are listed on our website and may be changed with 30 days' notice.

4.2 Payment

Payments are processed securely by Stripe. We accept major credit cards and certain cryptocurrencies via BTCPay.

4.3 Automatic Renewal

Unless cancelled, your subscription will automatically renew at the end of each period.

4.4 Refunds

In accordance with applicable law, you have a 14-day withdrawal period from subscription. Beyond this period, no refunds are granted except in exceptional cases.

5. Use of the Service

5.1 Authorized Use

You agree to use the Service lawfully and in accordance with these Terms.

5.2 Prohibited Uses

It is prohibited to:

Use the Service for illegal purposes
Attempt unauthorized access to the Service
Interfere with the operation of the Service
Resell or redistribute the Service without authorization
Use the Service for unsupervised automated trading without understanding the risks

6.3 Limitation of Liability

Under no circumstances shall Magic Position be held liable for financial losses resulting from use of the Service.

7. Intellectual Property

7.1 Magic Position Rights

The Service, its content, design, and source code are the exclusive property of Magic Position and are protected by intellectual property laws.

7.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8. Data Protection

The use of your personal data is governed by our Privacy Policy, available on our website.

9. Service Availability

9.1 Availability

We strive to ensure maximum availability of the Service but do not guarantee uninterrupted availability.

9.2 Maintenance

We may temporarily suspend the Service for maintenance operations, with reasonable notice when possible.

10. Limitation of Liability

To the extent permitted by law:

The Service is provided "as is" without warranty of any kind
We do not guarantee the accuracy of calculations or displayed data
Our total liability is limited to the amount paid by the User in the last 12 months
